Welcome to Flashcard Chess. These Terms of Service ("Terms") are a binding legal agreement between you ("you" or "your") and Flashcard Chess ("Flashcard Chess", "we", "us", or "our"), the operator of the website located at www.flashcardchess.net (the "Site") and the Flashcard Chess add-on for Anki (the "Add-on"). The Site, the Add-on, and all related features, content, and services are referred to together as the "Service".
Please read these Terms carefully. By creating an account, uploading a deck, downloading or syncing a deck, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of 18 (or the age of legal majority in your place of residence), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms.
The Service is intended for individual, personal use. You may not create accounts in bulk on behalf of other people (for example, a teacher creating accounts for a class).
2. Your Account
To access certain features, you must create an account. When you do, you agree to:
- provide accurate and current information, including a valid email address;
- keep your password confidential and secure;
- be solely responsible for all activity that occurs under your account; and
- notify us promptly at flashcardchess@gmail.com if you believe your account has been accessed without your authorization.
You may not use a username that impersonates another person, infringes anyone's rights, or is offensive or misleading. You are responsible for maintaining only one account unless we expressly permit otherwise. We may suspend or terminate accounts as described in Section 14.
3. The Service
Flashcard Chess is a community platform that lets registered users upload, share, browse, rate, bookmark, subscribe to, and comment on flashcard decks (primarily chess study material packaged for the Anki spaced-repetition system), and that may offer structured courses. The Add-on allows users to synchronize decks they have subscribed to into their own Anki collection.
Decks and other materials made available through the Service are submitted by users, not created or endorsed by us. We do not pre-screen, verify, or guarantee user-submitted content. You use such content at your own risk. See Sections 7 and 11.
4. User Content and License You Grant Us
"User Content" means anything you upload, submit, post, or transmit through the Service, including decks and the files you attach, deck titles, descriptions, and tags, comments, ratings, reports, profile information, and messages you send us.
You retain ownership of your User Content. We do not claim ownership of it.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for example, to create excerpts or thumbnails or to convert files to other formats), publish, publicly display, distribute, and otherwise make your User Content available to other users and to operate, provide, improve, and promote the Service. For User Content that you choose to make public (such as a shared deck or a comment), this license also allows us to make that content available to other users to download, view, and use as described in Section 7.
This license exists only so that we can run the Service. It ends when you remove your User Content or close your account, except that:
- residual copies may remain in backups, caches, or logs for a limited period;
- if you have shared a deck and other users have already downloaded or synced it, we cannot retrieve those copies, and your removal will only stop further distribution from us; and
- we may retain User Content where required to comply with law, resolve disputes, or enforce our agreements.
5. Your Representations About User Content
Each time you upload or share a deck or other material, and each time you confirm the acknowledgments presented to you at upload, you represent and warrant that:
- you are the creator of the content, or you have obtained all rights, licenses, consents, and permissions necessary to share it through the Service and to grant the license in Section 4;
- the content does not infringe or violate any copyright, trademark, patent, trade secret, privacy, publicity, or other right of any person or entity;
- the content does not contain viruses, malware, exploits, or other code or material designed to disrupt, damage, or gain unauthorized access to any system, data, or software;
- the content is not unlawful, defamatory, obscene, harassing, hateful, or otherwise objectionable, and does not violate any law in your country of residence or in the jurisdictions where the Service operates; and
- the content otherwise complies with these Terms.
Your local jurisdiction may permit you to use protected material privately under "fair use" or similar provisions, but that does not entitle you to share such material with others through the Service.
6. Acceptable Use
You agree not to, and not to attempt to, and not to permit or encourage others to:
- upload, share, or distribute content that infringes intellectual property rights, violates privacy or publicity rights, or is otherwise unlawful;
- upload malware, exploits, or any code intended to interfere with the Service or any user's device or data;
- harass, threaten, defame, impersonate, or harm other users, or post hateful, sexually explicit, or otherwise objectionable material;
- spam, advertise, or post repetitive, misleading, or low-quality content;
- use bots, scrapers, or other automated means to access, copy, or harvest the Service or its content, except as permitted by our published interfaces;
- attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe, scan, or test the vulnerability of the Service;
- circumvent, disable, or interfere with security features, rate limits, usage limits, or access controls;
- resell, sublicense, or commercially exploit the Service or other users' content except as expressly permitted; or
- use the Service in any way that violates any applicable law or these Terms.
We may investigate suspected violations and cooperate with law enforcement. Violations may result in removal of content, suspension, or termination, and may expose you to legal liability.
7. Content Made Available to You by Others
When you download, view, or sync a deck or other material that another user has shared, that user grants you a worldwide, royalty-free, non-exclusive license to use the material for your own personal study only. Unless the deck's author has expressly granted broader rights, you may not redistribute, re-upload, republish, sell, or otherwise use that material for any other purpose without the permission of the rights holder.
Decks, comments, and other materials provided by other users are not reviewed, verified, or endorsed by us, and we provide no warranty or support for them. They may also contain links to, or media hosted on, third-party servers we do not control; loading such links or media may reveal your IP address to, and cause cookies to be set by, those third parties. You are responsible for evaluating any third-party content before relying on it.
8. Community Features
Ratings, comments, reports, and similar features exist to help the community. You are responsible for your contributions and must follow the Acceptable Use rules in Section 6. We may, but are not obligated to, monitor, edit, or remove community contributions, and we may limit how frequently you may submit them.
9. Moderation and Removal
We are not obligated to pre-screen User Content, but we reserve the right, at our sole discretion and without notice, to review, refuse, remove, restrict, or disable access to any User Content, and to suspend or terminate any account, for any reason or no reason, including content we consider to infringe rights, violate these Terms, or be inappropriate, low-quality, or of use only to a very small group. We may also remove rarely-used shared content to manage our resources. We are not liable for any removal of, or failure to remove, any content.
10. Paid Content, Courses, and Donations
Some features, courses, or other materials may be offered for a fee. If you purchase paid content:
- Payment processing. Payments are processed by our third-party payment processor (currently Stripe). We do not collect or store your full payment card details; your payment information is handled by the processor under its own terms and privacy policy. You agree to provide accurate payment information and authorize the charges you incur.
- Pricing and availability. Prices, availability, and the contents of paid offerings may change. Taxes may apply.
- License to paid content. Unless stated otherwise at the point of sale, purchasing paid content grants you a personal, non-transferable, non-exclusive license to access and use that content for your own study. It does not transfer ownership and does not permit redistribution.
- Refunds. Except where required by law, fees are non-refundable. Any specific refund terms presented at the time of purchase will govern that purchase.
If we offer a way to support the Service through voluntary donations (for example, a "Buy Me a Coffee" link), donations are voluntary gifts, confer no goods, services, ownership, or other benefit unless we expressly say so, and are non-refundable.
11. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (b) ANY USER CONTENT IS ACCURATE, COMPLETE, RELIABLE, LAWFUL, OR NON-INFRINGING; OR (c) ANY ERRORS WILL BE CORRECTED. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICE IS ACCESSED AT YOUR OWN RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR DATA OR ANY LOSS THAT RESULTS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FLASHCARD CHESS OR ITS OPERATORS, CONTRIBUTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE TOTAL AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (b) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Flashcard Chess and its operators, contributors, and suppliers from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or of any right of any third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.
14. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to all or part of the Service, remove your content, or close your account at any time, with or without notice, including if we believe you have violated these Terms or if we discontinue the Service. Upon termination, the rights and licenses granted to you will end, and Sections 4 (residual copies), 5, 7, 11, 12, 13, 15, and 16, and any other provisions that by their nature should survive, will survive.
15. Copyright and Intellectual Property; DMCA Notice
We respect intellectual property rights and expect our users to do the same. The Flashcard Chess name, logo, the Site, the Add-on, and their design, text, and software (excluding User Content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Site and the Add-on for their intended purpose, subject to these Terms.
If you believe that content on the Service infringes your copyright, you may send a notice to our designated contact below. To be effective, your notice should include:
- your physical or electronic signature;
- identification of the copyrighted work you claim has been infringed;
- identification of the material you claim is infringing and enough information for us to locate it (for example, a link to the deck);
- your contact information (name, address, email, and telephone number);
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

If we remove material in response to a notice, we may notify the user who posted it, who may submit a counter-notice if they believe the material was removed in error. We will respond to valid counter-notices as required by applicable law. We will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.
16. Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in the Commonwealth of Pennsylvania will have exclusive jurisdiction over such disputes, except that we may seek injunctive relief in any court of competent jurisdiction. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your place of residence.
17. Changes to These Terms or the Service
We may modify these Terms at any time. If we make material changes, we will update the "Last Updated" date above and may provide additional notice (for example, a notice on the Site or by email). Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We may also change, suspend, or discontinue any part of the Service at any time.
18. General
These Terms, together with the Privacy Policy and any terms presented at the point of purchase, are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. Headings are for convenience only.
